One Person Can Start It

A short, plain note about how this works here. No advice, and nothing you need to memorise.

People picture a meeting.

They picture everybody in the family having to be in one room, or at least on one call, agreeing — and since that has never once happened about anything, the whole thing gets filed as impossible.

That picture is worth replacing, because it is the single thing most often keeping these houses exactly where they are.

The Shape of It

An estate does not have to be opened by everybody. One person can begin it.

That is the whole of the fact, and there is nothing you need to do with it.

It is not a vote, and it does not require unanimity to get started. Somebody puts it in front of the court and the court appoints. Everybody with an interest still has one — nobody loses anything by not being the one who started it — but the starting is not a group activity.

What This Does Not Change

It does not make the process quick, and we would not suggest that it does. It is a court process with its own pace, and it does not move faster because a family is anxious.

We are also not going to catalogue everything that can happen inside it. It would be frightening without being useful, and what applies depends entirely on the particular estate and what has actually been filed. A general answer would be a worse answer.

Why It Matters More Than It Sounds

Because until somebody is appointed, nobody in the family has authority to act on the property — however close they were to the person who died, and however obvious it is to everyone what ought to happen.

That is the part that surprises people, and it is not a technicality. It is the reason a family can agree completely and still find that nothing can be done.

The Part Most People Get Wrong

The most common mistake is not the delay. It is assuming that before anything can start, the family has to have decided what it wants.

That is backwards, and it is why these situations run for years. The deciding is easier once somebody has authority, not before — and the authority is the part that can be started by one person.

There Is Usually More Than One Thing Attached

This is worth knowing in outline rather than in detail.

A property can have more than one office with an interest in it, running to their own timetables, none of them aware of what the others have sent. That is not a trap anybody set — it is how the offices are arranged.

It also means what somebody believes is going on is often not the whole picture, usually because they have been reading one set of letters and not another.

What You Are Actually Allowed To Do

You are allowed to not understand it.

You are allowed to be grieving, to not know whether it is your place, to not know who is entitled or what is owed. You are allowed to be the only one of six willing to make a phone call.

None of that has to be resolved before somebody looks at it with you.

Where It Starts

Somebody finds out what is actually on the record — the owner as filed, what has been lodged against the property, and where things stand now. That takes one conversation and commits you to nothing.

If it turns out we are not the right people for it, we will say so plainly rather than string it out.

There is no bill for this conversation, and no obligation attached to it.
